Chrome Glow Policy Information

BUYER RESPONSIBILITY 

Purchasing online carries the responsibility of knowing what you are ordering, proper fitment to the application, care of the product and packaging in case a return is needed, and realizing installations can range from simple to having to hire an experienced motorcycle shop for installation. **Unless stated in the product description, all Products including but not limited to LED lights, license plate frames, bulbs, turn signals, brake lights, or light bars are NOT DOT approved and are sold for show and off road use only.**

DEFINITIONS

1) "Buyer" refers the individual or organization who buys or agrees to buy the Parts from the Seller;

2) "Seller" refers to 10-05 Enterprise Inc, that owns and operates the website ChromeGlow.com. and LightingMyCycle (eBay store).

3) "Agreement" means this contract between the Seller and the Buyer for the sale and purchase of Products incorporating these Terms and Conditions at time of purchase

4) "Product(s)" refers to the item(s) that the Buyer agrees to purchase from the Seller at ChromeGlow.com, LightingMyCycle (eBay), Chrome Glow Store, or Chrome Glow remote location (rally).

5) "Terms and Conditions" means the terms and conditions of sale set forth in this agreement and any special terms and conditions agreed in writing by the Seller.

6) "Website" refers to the website ChromeGlow.com or LightingMyCycle (eBay store) which was used to purchase Parts.

Terms and Conditions

CREDIT CARD AUTHORIZATION
By providing personal demographics, billing and credit card information, Buyer warrants to Seller that Buyer is the individual named on the Credit Card and that Buyer has authorization to use Credit Card or PayPal for the purchase of said Products and authorized Seller to charge credit card for the amount shown on the screen at the time of sale and that Buyer agrees to the Terms and Conditions of this Agreement.

TAXES
Tax will be collected for purchases made from a Buyer who has a billing or shipping address within the state of Florida. For international shipments, Buyer agrees to pay any additional fees charged by their government such as VAT, duty or other taxes or fees. Buyer authorizes Seller to charge the credit card used in this transaction to reimburse Seller for any fees charged Seller for any fees associated with the exportation of the Products.

EMAIL
Buyer must provide a valid email address for purposes of providing a receipt for confirming an order for the purchase of Products was received and for providing a detailed description and price for the Product purchased.

ORDERING
While Seller may have provided Sales or Product information either over the telephone, in person, or via email, Buyer is solely responsible for the proper configuration, fitment, and compatibility of purchased Product to work with Buyer's vehicle.

All orders for Products shall be deemed to be an offer by the Buyer to purchase Products pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

The Seller reserves the right to withdraw any Product(s) from the Website, eBay store, or store location at any time. The Seller shall not be liable to anyone for withdrawing any Product(s) from the Website or for refusing to process an order.

Cancellations / Returns / Exchanges / Discrepancies / Warranty

Order Cancellation Fee
An order for the purchase of Product(s) is considered "placed" once the Buyer has submitted the order, credit card or PayPal information is provided, and the card or PayPal account is charged for the Products. Any termination of the order after such time is considered a cancelled order, whether or not Product has shipped and is subject to $5.95 Cancellation Fee.

Order Return/Exchange Policy
A 15% Product Return/Exchange Fee applies to all items returned within 21 days from date of shipment. Returns require a Chrome Glow issued RMA number for return (see Return Authorization below). Buyer shall return all Products at Buyer's expense, insured and via a carrier that such delivery is trackable. Any missing parts, manuals, or packaging material shall be deducted from the refund in addition to the Product Return Fee.

Chrome Glow will NOT accept returns or exchanges of merchandise where as the manufacturer's packing has been opened or damaged where the product cannot be resold "as new" including but not limited to package top staples, seal boxes or bags, and vacuum sealed packaging.  Chrome Glow will NOT accept returns or exchanges of merchandise that shows signs of having been installed, used, mounted, scratched, assembled, or defaced. Items for return must be packaged in manner as to prevent damage during return. Any original shipping charges paid by Chrome Glow including orders shipped with "Free Shipping" will be deducted from any refund. Shipping charges will be applied to all exchanged items regardless of the value of the items (No free shipping on exchanges).

Refused Delivery
Delivery of the Products shall be made to the Buyer’s address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the Product(s) whenever they are tendered for delivery.

Should Buyer refuse the delivery of Products or otherwise be unavailable to accept delivery of Products, resulting in Products being returned to Seller, there will be a $14.00 Refused Package Fee along with a 15% Product Return Fee (stated above).

Return Authorization
RETURNED PRODUCTS WILL NOT BE ACCEPTED WITHOUT A CHROME GLOW ISSUED RMA# CLEARLY MARKED ON THE OUTSIDE OF PACKAGE!

RMA#'s are valid for 15 days from date issued. After 15 days from date of issue, product cannot be returned.

To obtain an RMA# (Return Merchandise Authorization Number) you must call 954-341-6640 and speak with a Sales Associate. Please have your original Invoice (order) number when you call.

All returns must be authorized by Chrome Glow within 21 days from date of original shipment. Refunds are for the cost of the Product only. All returns must be issued an RMA# before any returns or exchanges can be made. RMA#'s can be obtained by contacting Chrome Glow at 954-341-6640. Please have your order or invoice number when you call. Chrome Glow shipping department will not accept any returns without this number. RMA# must be clearly written on the outside of the returning package. The RMA# does not imply a replacement or refund, but only that the merchandise will be inspected based on your claim. Returns must be sent freight prepaid and insured by you. Original shipping and handling charges are not refundable. Refunds are for the cost of the product only. A photo copy of your order showing the order/invoice number must accompany your return along with a written explanation of return and a contact phone number where you can be reached.

It is the responsibility of the customer/installer to verify the correctness of size, application, and product condition before installation. Chrome Glow is not responsible for installation or removal fees for Products requiring warranty repair or replacement. All approved refunds will be paid by either Chrome Glow corporate check, Credit Card account credit, PayPal account credit, or Chrome Glow account credit, to be determined by Chrome Glow.

Any Product(s) that have been returned damaged and deemed as an unacceptable return, are subject to our actual shipping cost to return item back to Buyer. If Product is considered an unacceptable return, Buyer has 10 days to arrange return shipping. After 10 days, abandon Product will be disposed of.

Special Order or Clearance Items
No cancellations, refunds, or exchanges on special order items or custom order items will be allowed. No returns on items marked "Clearance".

Order Discrepancies or Shortages
Order discrepancies must be reported to Chrome Glow at 954-341-6640 within 7 days of receipt of order. Failure to report within this time will result in ineligibility for remedy.

Incorrect Delivery Address
Orders received with incorrect, misspelled, or undeliverable addresses are subject to a $14.00 Package Intercept or Address Correction charge.

Warranty
Seller warrants that the Product(s) shipped will reasonably correspond to the description and photographs shown by the Seller on ChromeGlow.com, Amazon.com, and in our eBay store.

Seller warrants that the Product(s) will correspond to the description given by the Seller. Except where the Buyer is dealing as a Consumer, all other warranties, conditions, or terms relating to fitness for purpose, merchantability, or condition of the Products, whether implied by Statute, common law or otherwise are excluded, and the Buyer is satisfied as to the suitability of the Products for the Buyer’s purpose.

No warranty whatsoever will be valid if the defect was caused by customer or installer abuse, negligence, and/or mishandling. All merchandise sold by Chrome Glow is only subject to manufacturer’s warranty, if any, and are subject to submission to the manufacturer for approval for repair or replacement of merchandise. The customer will be responsible for shipping and handling fees. No labor or inconvenience fee may be included in any claims.

Limited Warranty - Warrants that Products sold by Chrome Glow, if maintained and operated under normal conditions, shall be free from any defects in materials and workmanship for a period of one (1) year from the date of purchase, unless otherwise noted. Many products are covered under manufacturer's warranty as stated within the manufacturer's paperwork supplied with the item(s). Some items may contain longer manufacturer warranties. Customer is responsible for all return shipping charges.

LED Lifetime Warranty
Products sold by Chrome Glow, if maintained and operated under normal conditions, are covered for LED failure only. This does not cover failure due to abuse, negligence, and/or mishandling. Warranty applies to original purchaser is non-transferable.

Warranty Claims
No warranties will be accepted or honored without a copy of your original receipt. Defective items must be returned for inspection so we can determine if item can be repaired or needs replacement prior to Chrome Glow sending out a replacement item. Any other return conditions are subject to our Return Item Fee (see Return/Exchange Policy above).

Warranty claim items are subject to "Return Authorization" policy details above. Please include a written explanation and a contact phone number where we may be able to reach you along with your return. No warranty whatsoever will be valid if the defect was caused by customer abuse, negligence, and/or mishandling. All merchandise sold by Chrome Glow is only subject to manufacturers warranty, if any, and is subject to submission to the manufacturer for approval for repair or replacement of merchandise. Chrome Glow is not responsible for installation or removal fees for products requiring warranty repair or replacement.

Customer will be responsible for shipping fees both ways. Please note, if the item is tested and found NOT to be defective, the customer will be charged a $14.99 fee to inspect and re-ship the item; we encourage you to work with us to trouble-shoot any problem you may be having before sending an item back.

Warranty Processing & Return Shipping is at customer expense. You will be notified via email that your repaired/replacement warranty item is ready to ship. This email will instruct you on how to make payment for return shipping. Items not paid for after 30 days will be disposed of and warranty claim will be void.

Return Service Label
Within 10 days of shipment, for Products found to be defective, incorrect item, and/or needing repair or replacement, Chrome Glow will email you an RS (Return Services) label for return of the item. At that time we will determine if the Product will be repaired or replaced by Chrome Glow or if further assistance from the manufacturer will be required. If after 7 days you have not returned the item with the RS tag your warranty claim will be void. Chrome Glow will make every attempt to repair and return within 24 hours but in some cases item(s) may need to be sent to Manufacturer for repair/replacement. This policy is null and void if items have been installed.

For Order Discrepancies (see Order Discrepancies or Shortages above) the following applies;
Order discrepancies must be reported (via phone call) to Chrome Glow within 7 days of receipt of item(s). If an RS tag needs to be issued, customer will be required to provide us with a credit card number for authorization only for the cost of the item to be returned. If RS tag is used within 7 days of receipt of the replacement item Chrome Glow will release the funds "hold". If after 7 days the product hasn't been returned Chrome Glow will process the credit card for the amount of the authorization.

Specials & Promotional Codes

To receive any or all promotions listed you must use the promo code listed on the home page or in email promoting the special when instructed at checkout.

If you fail to use a promo code at the time of purchase (checkout), do not ask us to issue you a refund; simply save your promo code for your next purchase.

All sales listed as "Sale", "Promo", "Promotion", or "Special" will only be for time period listed by our email or home page description of the event. Events can be cancelled at any time without notice.

Promotional or Specials discounts DO NOT apply to shipping charges.

All Custom Dynamics® products are excluded from any and all online sales.

Remote Location Installs

We only accept returns within 5 business days on items purchased and /or installed by Chrome Glow that were purchased and/or installed at a remote location (other than Chrome Glow Shop). Remote location installs that require warranty work must be brought to our Coral Springs Shop for repair/replacement. Original installation cost is non-refundable.

Unless stipulated otherwise on the order, Products will be shipped via UPS Ground Service. While Seller can estimate the date of delivery, Seller is unable to provide an exact delivery date. Seller does not guarantee the accuracy of any information provided by delivery service.

If Buyer chooses to have Products delivered by any means other than Ground Service, Seller does not guarantee that Products will ship within a specified period of time or on a specific date nor does Seller guarantee shipment will arrive by the date specified or needed by the Buyer. Furthermore, Seller shall not provide replacement equipment at any other level of service other than Ground should Products be found to be damaged, defective or incomplete. If an order is Cancelled pursuant to policy Buyer assumes all risks associated with any level of service other than Ground.

Delivery of the Products shall be made to the Buyer’s address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the Product(s) whenever they are tendered for delivery.

Should Buyer refuse the delivery of Products or otherwise be unavailable to accept delivery of Products, resulting in Products being returned to Seller, the order shall be considered cancelled and subject to the Cancellation Policy described in "Cancellation Policy" section above including Returned Item Fee.

International Shipments
INTERNATIONAL ORDERS are ANY order(s) with a delivery destination outside of the 50 United States. These orders are classified as "International Orders" and are subject to Chrome Glow international order policies.

All international shipments from Chrome Glow are via UPS Worldwide Expedited service. We will not use USPS for any international order. Customers are responsible for paying any duties or taxes based on their country's import regulations. Our prices do not include taxes and tariffs. Customers outside of the United States may be required to pay these fees to the courier, as applicable, upon delivery. Please consult your local customs office or tax authority for information specific to your situation. Chrome Glow is not responsible for any applicable taxes, tariffs, fees, brokerage charges, customs charges, or any other charge that may arise due to an international shipment.

All international purchases using a credit card or PayPal must have the same "Bill To" and "Ship To" addresses. Customer is responsible for all international shipping cost and duty. 

Any special promotional shipping charges DO NOT apply to international shipments. Customer is responsible for all shipping cost, duty, and fees.

All warranties are VOID outside the United States.

The risk of loss or non-delivery of any merchandise shipped internationally passes to the customer (you) when the merchandise is transferred to the international shipping carrier. 

FORCE MAJEURE 

The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of parts or components from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

Indemnification
10-05 Inc, d.b.a. Chrome Glow, Chrome Glow Company shall not be liable for any consequential or incidental damages whatsoever. Unless otherwise noted in product description, all items are NOT DOT approved and are only for off road or show use. Use of these products may be limited, regulated, or prohibited in your state; please check with all applicable motor vehicle code and laws before purchasing/installing.

Customer agrees to defend, indemnify, and hold harmless 10-05 Inc, Chrome Glow, Chrome Glow Company, and its affiliates, or their respective officers, directors, employees, shareholders, agents, successors, or assigns from all liabilities, claims, and expenses, including attorney's fees, that arise from Customer's (a) breach of these Terms and Conditions of Sale; (b) use of any products purchased on ChromeGlow.com website. 10-05 Inc, Chrome Glow, Chrome Glow Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by Customer, in which event Customer will cooperate with 10-05 Inc, Chrome Glow, Chrome Glow Company in asserting any available defenses.
